Consent & Waiver

By participating in any services, sessions, courses, content usage and/or creation, partnerships, products, programs, teachings, events, or recordings (collectively referred to as “Services”) provided by Soulcur LLC (the “Company”), I, the undersigned, acknowledge and agree to the following terms and conditions. This Consent & Waiver is a legal agreement between me (the “Participant”) and the Company.

1. Assumption of Risk

I understand that the practices involved in breathwork, meditation, and related techniques (e.g., somatics, journaling, experience recall, movement, self-massage, acupressure, guided visualization, sound healing, etc.) can lead to altered physical, emotional, or psychological experiences. These may include, but are not limited to, emotional release, nervous system activation, physical discomfort, dizziness, strong emotional experiences, anxiety, hyperventilation, shaking, temperature changes, etc.

By participating in Services, Courses, Classes, Events, and/ or usage of Products, Content, Advice, and Guidance, I fully assume all risks related to the activities, and I release the Company, its instructors, employees, partners, teachers, and affiliates from any and all liability, claims, damages, or injuries, whether physical, emotional, or psychological, that may arise during or after my participation.

2. Health & Wellness Disclosure

I understand that breathwork and other practices may not be suitable for individuals with certain medical conditions, including but not limited to:

• Cardiovascular conditions

• Issues or history with high or low blood pressure

• Respiratory conditions (e.g., asthma, chronic lung conditions, COPD)

• Pregnancy

• A history of seizures, fainting, or passing out or related conditions (e.g. POTS)

• Mental health conditions (e.g., schizophrenia, anxiety, PTSD, depression)

• Active psychological distress or emotional overwhelm

• Recent surgeries or injuries

I confirm that I have provided full and accurate information regarding my current health status, including any conditions, medications, or concerns that may affect my participation. I agree to inform the facilitator if my health status changes or if I experience discomfort during the session. I affirm that I will self-determine and self-regulate according to personal experience and limits as needed, which includes but is not limited to stopping participation, modifying activities, etc.

3. Consent to Participate

I voluntarily choose to participate in the Services offered by Soulcur LLC and acknowledge that I have been given the opportunity to ask questions about the nature of the practices involved. I understand that the facilitator will guide the experience, but my participation is ultimately my own responsibility.

I acknowledge that I can opt-out of any activity or stop the session if I feel uncomfortable at any time.

4. No Liability for Outcomes

While the Company aims to provide a safe and supportive environment, I acknowledge that the outcomes of breathwork, meditation, and similar practices are subjective and may vary. I understand that these practices are not a substitute for medical or psychological treatment, and that no specific results or therapeutic benefits are guaranteed.

I release the Company, its instructors, and affiliates from any liability for any emotional, mental, or physical outcomes that arise from my participation in the Services.

5. Confidentiality & Privacy

I understand that the Company will respect my privacy and confidentiality. Any personal information shared during the Services will be kept confidential unless required by law or if there is a risk of harm to myself or others. I consent to the use of personal data for administrative and session-related purposes as outlined in the Company’s Privacy Policy.

6. Recording & Use of Content

I acknowledge that for Group events and/or Services, recordings (audio or video) may be made for internal use, further education, or promotional purposes. By participating, I grant the Company the right to use any recordings or content produced during these sessions and for these purposes. The creation of such recordings will be announced at the start of a Service.

7. Emergency Situations

In case of an emergency during a session, I authorize the facilitator to seek medical assistance on my behalf if necessary. I agree to be responsible for any costs related to medical or emergency care.

8. Cancellation & Rescheduling

I understand the Company’s cancellation and rescheduling policies, as outlined in the Terms of Service, and I agree to abide by those terms. I understand that failure to provide sufficient notice of cancellation or rescheduling may result in a charge for the full session.

9. Indemnification

I agree to indemnify, defend, and hold harmless Soulcur LLC, its instructors, employees, and affiliates from any and all claims, damages, liabilities, and expenses (including legal fees) arising from my participation in the Services, including any claims made by third parties.

10. Acknowledgment of Understanding

I confirm that I have read this Consent & Waiver in its entirety, that I understand its contents, and that I am participating in the Sessions voluntarily. I acknowledge that I have had the opportunity to ask questions and that all of my questions have been answered to my satisfaction.

By participating in our services, content, events, courses, or other materials produced by Soulcur LLC, you affirm that you voluntarily and knowingly agree to the terms and conditions set forth in this Consent & Waiver.
